Box Yard License Agreement & Yard Rules
1. The Basics
-
This is a month-to-month license. It’s not a lease and doesn’t give you any ownership or tenancy rights in the property.
-
It renews automatically each month until you or Box Yard gives 30 days’ written notice. Email is fine.
-
You may use only the space or container assigned to you.
-
Box Yard may move you to a similar space with 30 days’ notice for a fenced yard, or 5 days’ notice for a parking space. If we move you from a fenced yard, we’ll cover reasonable moving costs.
-
Your space is rented as-is.
2. Rent & Payments
-
Rent is due on the 1st of each month. Your first month is prorated to the 1st.
-
Last month’s rent is due at move-in.
-
If you give 30 days’ notice and move out on time, it covers your final month.
-
If you owe anything else, Box Yard may apply it to those amounts instead. That includes unpaid rent, late fees, cleaning, damage, or removal costs.
-
-
Autopay is required.
-
ACH (bank transfer) and debit cards: 0-1.95% fee.
-
Credit cards: a 2.95% processing fee, shown as a separate line on your receipt.
-
-
Rates may change with 30 days’ written notice.

6. Yard Rules
-
Lock the gate every time you enter or leave.
-
Park only in your assigned space. Vehicles parked anywhere else may be booted or towed at the owner’s expense.
-
This is a shared yard. Be respectful, and don’t enter other tenants’ spaces or the property owner’s office or yard.
-
There’s no trash service or utilities. Haul out your own trash. You may run your own generator.
-
Box Yard may inspect your space with reasonable notice.
7. Insurance, Security & Liability
-
Box Yard does not insure your property. Insuring everything you store is your responsibility.
-
Vehicles and trailers must carry at least the liability insurance Colorado law requires. Proof of insurance is due at move-in.
-
[Yard and container renters must also carry $1,000,000 in general liability coverage naming Box Yard LLC as an additional insured.]
-
The yard is unstaffed. Cameras may be present, but they aren’t monitored, and security isn’t guaranteed. Theft, vandalism, weather, and other losses can happen.
-
Box Yard isn’t liable for loss of or damage to your property, or for injuries on the property, except where the law doesn’t allow this limit.
-
You’ll cover Box Yard’s costs, including attorney’s fees, for claims arising from your use of the yard.
-
Box Yard’s total liability under this agreement won’t exceed $5,000.
8. Default, Lien & Sale of Property
NOTICE: All articles stored under the terms of this agreement will be sold or otherwise disposed of if no payment has been received for a continuous thirty-day period.
-
Lien. Under Colorado law (C.R.S. 38-21.5), Box Yard has a lien on all property at your space from the day it’s brought in. The lien covers unpaid rent, late fees, and the costs of enforcing it.
-
No action before day 31. Box Yard won’t take enforcement action until your account has been in default for 30 continuous days.
-
Written notice. Before any sale, Box Yard will deliver written notice to you in person, by verified mail, or by email. If an email notice isn’t confirmed, we’ll also send it by verified mail. The notice includes:
-
An itemized statement of what you owe and when it became due.
-
A general description of the property.
-
Notice that your access is denied, and who to contact.
-
At least 15 days to pay.
-
The date and place of the sale.
-
-
Lienholders you’ve disclosed will also be notified.
-
The sale. If you don’t pay by the deadline, the sale will be advertised in a commercially reasonable manner. It will be held on a public online auction site, at the yard, or at the nearest suitable location. Box Yard’s practice is not to hold a sale before day 60.
-
Vehicles and trailers unpaid for 60 days may be towed by a licensed towing company. Once towed, Box Yard isn’t responsible for them.
-
Proceeds. Sale money pays what you owe first. Any balance is held for you for 3 years. You remain responsible for any amount still owed, plus reasonable collection and attorney’s fees.
-
Military service. If you’re on active military duty, tell Box Yard right away.
-
Other violations. Breaking these rules can also end your agreement after 5 days’ written notice to fix the problem.
9. Moving Out
-
Give 30 days’ written notice.
-
Remove all your property and your lock, and leave your space and container clean.
-
Anything left after move-out may be removed or disposed of at your cost.
10. Legal
-
This agreement is governed by Colorado law. Any legal action will be brought in the district court for the county where your yard is located.
-
Both parties waive the right to a jury trial.
-
The winning party in any legal dispute recovers reasonable attorney’s fees.
-
You may not sublet or transfer your space. Box Yard may assign this agreement.
-
Notices may be sent by email to the address on your account.
-
You pay any personal property taxes on your property.
-
If someone guarantees your agreement, they’re bound by these terms.
-
If any term is unenforceable, the rest still applies.
-
These terms plus your signed agreement are the entire agreement. Changes must be in writing.
